Legal Question in Family Law in California

my child's name

I share joint legal custody with my five year old's mother. Her last name has contained my last name since birth; it is on her birth certificate and all court orders.

Her mother, just recently, has come up with the idea that she no longer wants my name as a part of my daughters. I have been actively involved in her life since she was born. I would like her name to remain the same.

Is it possible or likely that the mother can get the name changed this late in the situation? If so, why- or why not?

Re: my child's name

The name could not be changed without notice to you and with little doubt would not be changed over your objection. It would put you in even a stronger position if you had joint legal custody, by court order. Good Luck, Pat McCrary
