Legal Question in Family Law in California

Child's wishes

My son, age 11 wishes to legally change his name to my new married name. At what age can he legally request this to be done? Can his biological father (not named on the birth certiifcate - though paying child support) stop him? If he doesn't do this through the court system, how do we get the schools to accept his name change and record it accordingly.

Thank you.

Re: Child's wishes

There is no law preventing you or your child from using any name you want without going to court. As far as the school system, they all have different policies. Changing the name in court is pretty easy. You would have to serve copies of the paperwork to the dad then it would be up to him to go to court and oppose it.
