Legal Question in Family Law in California
childsupportandstepparents
My ex is on SSI disability, child support does not exceed 20% of that, his new spouse works, income counted with his, is there any way to get support modified to count her income in the child support, or is there a way to get more of his SSI?

Re: childsupportandstepparents
The new spouse is not considered when setting child support unless it changes the amount of income taxes paid by the supporting parent. The children are entitled to receive social security benefits through the fathers social security benefits.
