Legal Question in Family Law in California

CHILS sUPPORT FOR A CHILD THAT IS NOT MINE

I was recently notified by my employer that my wages are being garnished due to oweing child support. I never had sex with this woman and did not no that she was naming me the father. Apperently I was served papers but I wasn't. I was not even living in the State of California when they were served,and they were served to my x-step brother at his address. I was never informed of this as we don't have any communication. I have requested a paternity test in writing, however I was served yesterday at my home a final judgement from the superior court ordering me to pay. How can I contest this if it is already a final judgement. What are the steps I have to take to appeal this action? Do I have to prove I was never served? PLease help me.

You need to set aside the judgment for lack of service. Your time for setting aside that judgment is limited. That is why they served on you a copy of the judgment to limit the time for you to act. Retain an attorney, it would be unwise to attempt this on your own. If you lose, you pay for the child until he is an adult. Good Luck, Pat McCrary

You need to take copies of the paperwork that you have and consult with an experienced family law lawyer IMMEDIATELY. Time is not on your side, and sitting back and doing nothing is not in your best interests.
