Does she have a choice?

I share 50/50 physical custody of my daughter with my ex-wife. My daughter will be 11 this year. She has expressed to me that she would like to live with me full-time. Does she have a choice? Her mother is not likely to be open to this. Will I have to take her to court for custody? Or is there an easier way?

Of course your daughter has a choice but her opinion is only one factor. Other than reaching an agreement with Mother there is only the courts. That's why mediation before the hearing is mandatory. You can also go to a private mediator to try for an agreement.
