Legal Question in Family Law in California

Christmas Bonus

My ex-wife and I have been divorced for about almost two years. I received a Christmas bonus this year and she says she is entitled to some of it. I pay her child support regularly (one child). Is this true?

Re: Christmas Bonus

Unless your child support order states that she is to receive a portion of your bonus she is not entitled to that bonus. However, if you normally receive a bonus the court can consider that bonus in calculating child support. Call me and set up a free phone appointment and I will calculate your guideline support to see if that support should go up. You may rather keep her happy than to have her go back to court to set the current guideline support. Good Luck, Pat McCrary
