Legal Question in Family Law in California

Cildren taken Out-Of-State without required notification

My children were taken out of CA. by ''Dad'' without the required written notification including itinerary and emergency contact numbers. What can i do to get him reprimanded by the courts and help me get more of a percentage of ''Time-sharing'' since he won't follow the outlined ''Rule'' in the Dissolution paperwork?

You can file an OSC re: Contempt. You should obtain an attorney to help you either prepare the motion or represent you on the motion. Contempts are criminal in nature and must be handled differently from the regular family law motions.

If you are in Santa Clara County you can contact my office at (408) 287-8484 to schedule an initial consultation.

File for contempt of court for violating court orders. A hearing will be scheduled. To modify visitation or custody, an OSC needs to be filed. You would be well served by obtaining representation. Please call me directly at (619)222-3504
