You can't sue him for the affair. I strongly recommend that you find a good therapist to help with the depression you must be experiencing. Use your energy in a positive way. You can and will get past this and with or without the help of a therapist. If you go to a therapist, however, you will very likely take less time and you'll be better prepared for what the next chapter in your life brings. Forget about the other guy. He will always be wondering if your soon to be ex is cheating on him. Remember what comes around goes around.
