Legal Question in Family Law in California
Claiming a child as a tax deduction
I have lived alone with my son since he was seven months old. His father does not pay child conventional child support but shares cost of day care with me 50/50. He also stays with his father 2 days/nights a week. He has been doing this since he turned two four months ago. He asked to claim him this year on his taxes and alternate every other year going forward. Does he have this right?

Re: Claiming a child as a tax deduction
The parent with whom the child resides for the greater part of the year has the right to claim the child as a dependent. Keep a record of the time the child is with your and the time the child is with dad. Just tell him no.
