Client Competentcy

My 54 year old wife, preliminarily diagnosed with Alzheimer's has been led by my 23 year old daughter to an attorney who has filed for divorce. My daughter is executing the separation on behalf of my wife. No one is a legal guardian. What is the attorney's responsibility and liability?

File a petition to be appointed her conservator. This should also address the issue of the divorce. If she was incompetent then the entire divorce process should be voidable.
