Legal Question in Family Law in California
Hello, i am close to closing in on a injury settlement andi owe back child support. my ex ee yiing she is gonna collect more than half of that money. my question is can she? and if she can is there anyway to block that? i was the one who got injured and still am and i thin k its only right for me to get that money i deserve for suffering through all of this pain. im going to pay child support but find it super unfair to collect that money which i havent worked to close to a year and i owe lots of money already. its very complicated

If she knows what she is doing, she can get a lien on any judgment or settlement that you are attempting to recover. My best advice is for you to pay the back child support.
If you owe back child support, obtaining a settlement is actually a God send to you, so that you can get caught up, or at least on your way to getting caught up.

She does not receive one half of the settlement as a property right, but she could collect the back due child support from the settlement. I would suggest that you get a consultation with a family law attorney so that you will know your rights and obligations. Good Luck, Pat McCrary
