Legal Question in Family Law in California

Cohabitation by ex spouses

Our divorce is not final.

I receive spousal support. If I cohabitate under what conditions will it be reduced or terminated?

Part II: If my ex-spouse is currently cohabitating am I entitled to more spousal support from him if her income comes into their picture?

Re: Cohabitation by ex spouses

California family code provides that there is a presumption of reduced need for spousal support if you cohabitate with a person of the opposite sex. The degree to which this will reduce spousal support depends on the facts of your case.

The income of your ex's live in girl friend will not increase tha amount of spousal support.
