Legal Question in Family Law in California

collecting overpaid child support

i was informed by my county child support agency that their worker was frauding and incorrectly closed my family support case. i was told i overpaid my child support by 3,500.00 and i cannot get it back unless i take that person to small claims court. i was told they do not do that and it was my fault in the 1st place since they never received the new court order putting the support on reserve. can i force them to collect? if not is there a time limit I would have to go to small claims court? Would't they have to provide me with written documentation for the amount overpaid?

Re: collecting overpaid child support

sue both the worker and the county in small claims court--note that you will need to first file a claim against the county--you will need to contact the county offices and ask them for a claim form.
