Legal Question in Family Law in California
Collection for an Equalizer award in Judgment
In an uncontested divorce I have been awarded an equalizer in excess of $22000., payable in monthly installments of $200. per month beginning Jan 2000.
So far payments are three months in arrears. Divorce was filed in pro per due to financial reasons. What is my best recourse for collection--to file a Writ of Execution and then proceed with a wage garnishment? What I do will have to be without the assistance of a lawyer. Is he now in default and the whole amount is due, due to not making the monthly payments?
Currently, I know of his employer. He owns no property; because of a poor credit history he never will. He will have a checking account with a balance of under $1000, which I can also attach after securing the account number.
Do you have any further suggestions or procedure recommendations that I should follow, that may help me with collection? Thank you.

Not having a lawyer was maybe penny wise and pound foolish if you can't collect the $22k. You can get the writ and go after his wages. Good luck.
