I have been dating someone for 5 years and have been living with her for 3 years and she has two children from a previous marriage and I have 3 children from a previous marriage.I want to know if there is common law in Califoria and how effective are pre-nuptual agreements ? I have a house and a sound bank account..How does a pre nup work?

There is no recognition of common law marriage in California. A pre nuptial agreement can protect you only if it is prepared by an experienced family law lawyer.

California has no statutory provision which creates a common law marriage. However, a common law marriage that occurred in another state would be recognized in California. Even with a well drafted prenuptial agreement you should keep your separate property funds in a separate bank account, and have an accurate record of your separate property and her separate property. These lists should be a part of the prenuptial agreement.
