Legal Question in Family Law in California

common law marriage

My dear friend is trying to get social security from her deceased exhusband account. They tell her that common law marriages weren't recognized in California in the sixties. Is that true?

Re: common law marriage

California has no provision for a couple to be come married merely by living together as husband and wife. It does however, recognize a common law marriage that has occurred in another state. Example a man and woman live together in Texas and comply with the requirements for them to have a common law marriage. That common law marriage would be recognized in California.
