Common Law Marriage

I lived with my fiance in california for 5 years. we broke up 2 yrs ago. Is there such a thing as common law marriage in california? If so, Can I sue him even though it has been 2 years since we have been togather?

No common law in California. You might have a right to palimony, but, since the relationship was of short duration, you wouldn't be entitled to much. The attorneys fees would chew up any amounts you might be entitled to. Good luck and thanks for inquiring.

california does not recognize common law marriages, at least those that are claiming to have originated in california as opposed to outside of california in a common law marriage state. thus, you would not have standing for common law marriage in california as i understand your facts to date. however, you may be able to "sue" under a contractual type relationship if you feel you are owed money, etc..from your former mate. feel free to email me directly with your contact information for a free case evaluation/consultation.

California is not a common law marriage state, However, "Palomony" has been etablished via actor Lee Marvin and his live-in girlfreind's civil action. Therefore you may sue for supplemental income if separation will decrease your standard of living. Call me directly at (619) 222-3504.
