Legal Question in Family Law in California

Common Law Marriage

I've had a live-in relationship with the same man 15plus years. He has been the full provider and I have been a stay at home ''housewife''(no kids). We are splitting up (due to his unfaithfulness and lies) and I need to know if I have any rights? Are we in a common law marriage? We own a home and he pays for everything. Thank you

Re: Common Law Marriage

California has no provision for common law marriage. But does recognize common law marriages that occur in other states. If you have lived in a state other than California you should investigate whether or not a common law marriage occurred. As a live in you have no statutory right to support. If there are children then child support would be payable. You may be able to get some relief under a theory other than family law. consult an attorney.
