Is there such thing as commonlaw marriage in California and if so what rights does it provide?

California law does not provide for common law marriage. That is no matter how long a couple may live together as husband and wife they are not married. However, California law recognizes common law marriages that occur under the laws of another state.

The same community property laws apply to a common law marriage, which is recognized in California, as to applies to a marriage.
