Communal Proprety

My husband and I have been emotionally separated for 5 years. He claims that all assets aquired after 2002 are his sole property. However, we have bought property together and I have signed loan agreements for his business where I am personally liable over these last years. What is the law on this?

The issues are too complex to give you an answer that has any credibility. I suggest that you talk to an

attorney so that he can obtain all of the relevant facts. However, with that being said, based on the limited information that you have given, it is probable that you are not separated as defined by the family code. I had a three day trial on this issue, the judge took it under submission (meaning she was going to review the facts and the law and give us a decision on a later date) and three days later a case came down from the court of appeal changing how separation would be defined. I took the matter on appeal and settled it while the appeal was pending. You really, really need an attorney on this, it is a complex area of law. Good Luck, Pat McCrary
