Legal Question in Family Law in California
community property
my husband and i reside in california and i'm looking to divorce him because of his controlling ways but during the marriage which i'm still in now and its hard to get out of because of this he has opened up bank accounts with only his name on the accounts and also got a po box so that all of the business checks that come in for our business go to an address which leaves me with no access to any money. how since it is community property could i access it so that i dont have to be controlled by him and beg for every dollar from him. the banks will do nothing and its hard to get anything done about this with him controlling every dime. thank you.

Re: community property
He owes you a fiduciary duty to diclose the assets. When that doesn't happen, people handle it in different ways. You might consider going to marriage counseling. Perhaps a third party could help by reminding him of his duties as a spouse.
