Legal Question in Family Law in California

Community property after settlement

My divorce was final and filed on September 3, 1999.

I recently learned that on September 23rd, 1999 my exwife, unknown to me, took 34,000 miles out of my frequent flier account. The ticket was worth approximately $2300. I owe her money for misc. children's activities (camp, sports, etc.). Can I use this money in part or all against these activities?

Re: Community property after settlement

No you cannot. If there is a child support order or any order for payment that is in lieu of child support you can not offset unless you and the opposing side sign a stipulation. Other than that you may file your own motion requesting reimbursement or requesting a proper relief from the court. If you have any other questions you may call my office at 310-839-7700 for making a appointment for a free initial office consulation.
