consent for minor name change

I have sole physical and legal custody of my son. His father has been permanently deported from this country and has not been in contact with my son for two years. Do I have to make an attempt to contact him for consent to a name change for my son? Can this be avoided, as I would prefer him to not be cognizant of our new identities?

I think you do need to give the father notice. However, you may be able to give notice by publication.

If indeed you do have sole legal custody, then you do not need the father's approval, nor do you have to give him notice.
