Legal Question in Family Law in California

Conservatorship?

my child was born 2 weeks ago. The mother of my fiance has conservatorship over her. The mother talked hospital security into banning me from the labor room, insisting she had an active restraining order. To clarify the issue, I called local law enforcement. No restraining order was in effect, yet they still forbade me from entering the delivery room. Is this legal?

Re: Conservatorship?

Probably. I do not know of any laws that regulate who can and cannot be in the hospital room. Hospital rooms are not a public place so the hospital is free to set rules as a private place. You are subject to the hospital rules which probably give the person in labor the discretion to decide who may be present and who may not since she is the one in labor and is their patron. Since the mother of the mother is the conservator, she now has that decision making power. At this point, you can file for custody and visitation if you are the father and with that comes 18 years of child support. Good luck.
