Is everything considerd No Fault?

Been married two years; living in California. Am employed at $40k year.Husband is retired Colonel;Army.I have lived with him (aggregate) over 3years;married 2. He owned a home, which I too lived in, in AZ.We sold it and bought in Calif.He qualified for loan, but I am on title(HWJT).Calif home was purchased with proceeds from AZ home, on which I was also on title. Calif home purchased Oct 2004 at,$279,900; now appraised at $475,000. Discovered Husband subscribed to Swingers internet site,Oct 2004 to-date, and is in online contact with Swingers in our area.Don't know if he's met with any yet, but am seriously concerned about contracting STDs,or worse. I have proof. Is this grounds for collecting anything in a divorce? He pays mortgage and property tax bills. The cars are in his name; both paid for. He has start-up business as a Financial Advisor; not too much incomeyet. He has retirement income from the Army money in investments.If I file for divorce,what would I be entitled to? I do intend to use this Swingers stuff (printed off the internet, from his e-mail account; Confirmation of subsription, correspondence with other Swingers in the area, and his profile on this website).

You do not need grounds to file for a dissolution of your marriage. You have a substantial interest in the house, at least one half of the appreciation, probably more, but more information is needed. You probably have an interest in his business. You should talk to a family law attorney who can ask you questions and give you a more definitive analysis. Good Luck, Pat McCrary
