Legal Question in Family Law in California

hello i am contacting you in regards of my six yr old daughter. her dad and i have shared custody of her for the last five yrs. we were never married nor do we have a court order custoday, we just decided on our own to share custody. things were going well until recently. i have reason to believe that her dad is marijuana abuser. i now want to have her with me at all times and now and very concerned of my daughters safety when she is with him. what i what to know is: do i as the mother do i have all custody rights if we were never married? am i allowed to take her away from her dad and not have the court involved? i know he is going to put up a fight when i tell him she cannot stay with himany more. your help is greatly appreciated

There is no difference in parental rights between parents who are married, have been married and no longer are, and never-married parents.
