Legal Question in Family Law in California

contempt of court

If your divorce papers state neither party is to take the children out of the state and the father does, and takes up residence there, with out consent from me or the court. The one child resided with me and one child lived with him. Now I see neither child and want them here where I can visit often and help raise them like I have. we use to have joint custody and him physical. I believe I now have physical since I took him to court last. I am in waiting for the court to pull the file to find out. What can I do? I know the kids don't want to live with me, They hate my rules. They are 15 and 14 and abuse me when they live with me, I want physical custody but my new family can't handel all the abuse from them. What can I legaly do to get my children back here where I can help them and be a part of their life?

The court could order him to return the children to California, but cannot stop him from moving. If the children do not live with you then they will be living with him. You should look into getting counseling with your childen to work out the problems that exist between you and them. Before you act you should carefully think through the problems which you face and how to sovle them. Then with a clear plan in mind you can determine which option you want take.
