Contempt of court orders

According to the recient court order for custody, that I and my ex agreed to, He is to use the same child care provider as me. His time with our son is from mon 6pm- wed 6pm and alternating weekends. He works from mon 2pm until tuesday eveing, and so on. He is ordered to use the same child care provider but states that when he is at work that he will not do this and will use his friend so that he dose not have to pay, the sitter. Can he do this if he already agreed and signed that he would bring our son to the same sitter?

A court order is a court order and if he does not follow it he is in contempt of court.
