Legal Question in Family Law in California

contempt for not paying child support

I want to file contempt in California for not paying court ordered child support. My ex is $25000 in arrears and has not made a single payment in over a year. Can you give me a law code I can quote on the grounds of this contempt? Also, if she has not payed in over twelve months for our 2 kids, can I quote that I want it to be 12 counts? Can I double the counts since it is for two children?

Re: contempt for not paying child support

Contempt is a quasi-criminal action with all of the criminal protections for the defendant. It is highly unlikely that a non-attorney could prosecute a contempt. Most attorneys could not prosecute a contempt. I suggest that you talk to an attorney about enforcement or contact the Department of Child Support Services. A private attorney is faster and more efficient, but the DCSS is cheaper and has some remedies that private attorneys do not have. I suggest you talk to a private attorney first.
