Contempt in San Diego
To whom it may concern:
I have a court date coming up very soon (in less than a week). It is a case brought by the San Diego district attorney's office against the father of my child for non-payment of child support. There is 12 counts against him. My question is, he has been currently paying child support for about 2 months. Could he still be found in contempt? And what can I expect to come out of this? Jail time, a fine, or what? Thank you very much for your time and help.

Each court and judge has a policy regarding contempt. Many judges will place the person on probation for a period of time. Often the period of probation is 6 months to one year. So long as he pays his monthly support and the court ordered payment on the arrearages he would not be put in jail.
The maximum sentence is 5 days in county jail and/or a fine of $1,500 per count of contempt. Each monthly payment that is not made is a separate count of contempt.
