Legal Question in Family Law in California

Contested guardianships/visitation rights

I am the petitioner in a guardianship. The court appointed attorney for the minor and Family Court Services who conducted their formal investigations of all parties have recommended that I would become my nephews permanent legal guardian. Nephew has been abandoned by mom and dad has never been responsible for child financially or any other way. Mom's not anywhere to be found, dad wants to have more visitation on his terms despite counsel's and Family Court Services strict visitation requirements. Is there anything I need to do to ensure dad follows visitation requirements, is there any way dad can get custody despite his complete absence from child's life?

Re: Contested guardianships/visitation rights

You must insist that he follow the court ordered visitation. If he does not return the child that get the police to go with you, be sure to have a certified copy of the court order appointing you guardian, and get the child back. If he continues to violate the court order, file a OSC contempt and request that his visitation be supervised.
