Legal Question in Family Law in California

contract in breach for joint custody

Hello,

My ex wife and I have been through

the court system and have filed joint

physical custody and joint legal

custody. My ex wife is now trying to

control when I see our two year old

daughter and insists that they be

supervised. I have caused no harm to

my daughter. How can I fight this?

What are the steps I have to take?

She's breached the contract.

Re: contract in breach for joint custody

you need to file a response. if she violated the court's order you might want to consider bringing a contempt action against her.

You absolutely can and should fight this. She needs to understand that joint custody means just that, there is nothing that gives her control. The child needs both parents. You need to file a motion to modify the order and set a child sharing schedule. I suggest that you get an attorney this time, I think you will be happier with the outcome and the stability for the child will be improved. Good Luck, Pat McCrary
