Legal Question in Family Law in California
cost of child support
My husband has a 16 year daughter out of wedlock and is not listed on the birth certificate. He's never been asked for child support until recently. The mother of this child is collect child support for another child from a different father and would now like to receive money from my husband. How does the state compute the monthly payments, what is the formula to figure this out? And will he have to pay for the past years, if so, how much? The mother of his child would like to receive a lump sum of $29,000 plus anything else my husband would like to buy or pay for. Is this a reasonable price to pay for the past, present & the next two years?

Child support will have to be paid prospectively not retroactively. The calculation is available at any family law lawyers office and at some locations on the internet. I offer that service at my web site.
I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

Re: cost of child support
He is no liable for support for any time prior to the date that an action is filed with the court. The exception is if she is receiving welfare payments. The county can go back for 3 years.
Second he cannot buy out of future child support.
Child support will be based on his gross income, the number of dependents etc which affect the amount of income taxes he pays. He should discuss this with an attorney.
Paying her a lump sum for support past and future is risky.
