Legal Question in Family Law in California

Does the County have legal grounds to successfully sue someone for child support if the Custodial parent is receiving voluntary child support payments from the Non-Custodial Parent and is also enrolled in this parent's Healthcare insurance plan?

The mother and child are not receiving assistance from the federal government or State.

Yes, although the non-custodial parent gets credit for payments they can prove they made. But if there is no support order, and the custodial parent is getting public assistance, the County has every right to sue to establish court ordered support and collect it as partial or full reimbursement for the money the county is paying. And by the way, the state and federal assistance is all administered at the county level.

If the county is involved you need to start paying them, otherwise your payment may not count.
