Legal Question in Family Law in California

Court appointed attorney for minor children

Father is not represented by an atty. Mother is. 2 minor sons were appointed an atty by the court. Mother made arrangements to have oldest son (17) move back to county father resides in to live with paternal grandparents.

Isn't the children's attorney required to discuss with, or notify father of the move?

(Father has been trying to resolve custody issue and his letters and calls to ex wife's attorney have been ignored. Mother stopped court-ordered weekend visits and Father hasn't seen sons in months.) Thank you.

Father must take an active role. Court orders are not enforced undless someone brings the issue before the court. An OSC in Re Contempt can be filed for the missed visits. The issue of the 17 year living with maternal grandparents could also be addresses in a motion to modify custody. Generally a parent has a superior right to custody over any other party. However a 17 year old child will live where that child wants to live.
