Court Appointed Attorneys for out-of-state parent
My daughter left California with her son and the father hired a lawyer to fight for custody. She requested a court appointed attorney because she lived in Ohio, working, and my grandson in school. She wrote saying she could not afford to come to California or a lawyer and so they automatically gave custody to the father and made her return her son to California to his father with threats of going to jail. She did not get a say at all. NO representation and the father has not let her see the child in over two years. Why didn't someone let her have her say, before they made a judgement? She is still trying to fight this, as the father is illegal from Mexico, fake social security number, etc. is there anything she can do?

There is no right to a court appointed attorney in a custody case. HIRE AN ATTORNEY. The judge is going to wonder what took her so long to file the motion, but she should certainly be able to improve her situation. She made a baby with an illegal alien. The argument that he is illegal will not go a long way in court. Good Luck, Pat McCrary
