Legal Question in Family Law in California

No court Date

I'ved been separated from my husband for 3 years now. We have a 5 year old daughter. He recently filed & served me with divorce papers, but all I got was a Summons, Petition and a declaration under uniform child custody form. There is no court date. I know he just wants a divorce. He's not intrested in getting physical custody of our daughter. I didn't get a declaration from him nor blank forms to respond to.What should I do? Are there more forms coming? Should I be worried? Is something missing???

There will be no Court date unless one of you either files an OSC for child support, custody, etc. Eventually one of you will either request a trial date from the Court or request that your divorce be finalized by stipulated judgement.

Your husband was supposed to serve you with blank response forms.

You are probably going to want to do an OSC for Child Custody and Support just so that you have a temporary order for custody and support. I would respond, and do an osc for child custody and support immediately.

The basic dissolution does not include a court date but you should have gotten a blank Response form. You can get one on-line or from the family law clerk. You also should get a fee waiver application and order if you are eligible. The Family Law Facilitator is free if you need some help.
