Legal Question in Family Law in California

My court order for child support is now being modified. The obligator is trying to modify it to $0. Is this possible, since he is now receiving public assistance since december of 09?

If the obligor is on welfare, then most likely the income he receives is not income because it is from the government aid. Your child support would most likely be reduced to 0. You should make sure that he continues his efforts to get off welfare though and find a steady job.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
