Legal Question in Family Law in California
We have a court order detailing the time and days child is with each of us. Father refuses to exchange child and i document it with a police incident report. Every now and then he will let me see child. I have tried taking child during a visit and he became very violent. To avoid the physical violence, I do not try taking her when he does allow me to see her since I plan to go back to family court. He is present at all times during the visits. The visits are not by agreement but obligation and is the only way for my daughter and I to bond.
My question:
Father pays child support. I use the money to buy anything I think our daughter need, what he tell me she need and all her groceries for his house.
He has now filed a modification for child support and requesting back pay.
I am in the process of looking for an attorney to file contempt of court order for his violation of our custody/visitation order.
He us saying he has full custody of child, but this is only because he refuses to give child to me on my days. He is manipulating the situation in order to not pay child support.
*How can I oppose his actions?
*Will it help my case with child support to complete the contempt case first?
*If so, can i request more time from child support to complete the contempt case?
