Legal Question in Family Law in California
Court Order Medical Insurance - Reimbursement
AM I RUNNING OUT OF TIME?
Can you answer a question re a court order re providing medical insurance for minor. This Order has been in effect since Jan 1987, and he has never provided insurance. The child will be 18 in a few days.
Pursuant to the Court Order it states: ''That the absent father shall provide reasonable and appropriate medical insurance for the minor child until that child attains the age of eighteen (18) (or nineteen (19) if still a full-time high school student), dies, marries, is emanicipted or by further court order, whichever occurs first.''
QUESTION:
The child will turn 18, however, she is a full time high school student until June 2003. Since the father has never provided insurance or money in lieu of providing insurance. Can I still go to court to enforce this order? We both share legal responsibility for the minor child, the father is obligated to provide for the current insurance that I provide, and I feel that a reimbursement is in order for the past 16 years in which I provided medical insurance, dental, vision, etc. without fail. Does the order expire because she turns 18, or can I still take this matter to court after she turns 18 or 19 if a full time student?

Payment for sums previously ordered can be enforced after the child is 18.
