Legal Question in Family Law in California

Per court order i have my sons on the weekend but mother picks and chooses when she wants to drop them off. what can i do? can the police enforce the order?

also we have joint legal and physical custody. we are supposed to agree to school and health decisons but she does not adhere. what can i do? she says no court will tell her what to do with her children.

If the mother refuses to abide by the court orders, you may need to file a request to change custody. The courts favor the parent who is most willing to provide the non-custodial parent with access to the children. You may file contempt with the court and request for the modification of custody based on the contempt. You may wish to contact a family law attorney to discuss your options with you.

With the possibility of a court battle looming, your ex may see the wisdom of participating in co parenting counseling to improve your abilities to communicate with one another as well as mediation on the other parenting issues you raised so you both can settle terms on sharing the school and health decisions. Any agreements reached should be reduced to a written stipulation and court order so they are enforceable.
