Legal Question in Family Law in California

Court Order Violations...what can I do?

The mother of my child constantly

violates court orders and most of the

time gets away with it. She has

taken my son outside the State twice

when there was a a court that states

she can't. She has had my child

aound an individual that the court

order said she couldn't do. The most

recent one is The court order says

that whoever one of us moves to a

different address...that persons

within 24hrs of moving has to

provide the other one with the new

address. She moved around mid-Feb

09 and just 3 days ago gave me her

new address. I e-mail her month ago

telling her that I know she moved

and asking her for her new address.

She ignored the message and did not

mail it to me until 3days ago. I'm

sure she only gave me the address

because we go to court tomorrow.

Should I mention this in court?. I

have physical custody of my

daughter and I wanted her new

address to update the records at my

daughter's school. I was able to

update the school records until

yesterday because she didn't do that

either. What can I do to get her to

start respecting the court orders?.

Re: Court Order Violations...what can I do?

You should file a motion for enforcement of court orders and have the judge reprimand her and make additional orders to enforce his original orders. If that does not work then you can file for a contempt and have the other party put in jail for violating court orders.

As always please consult an attorney prior to taking any legal action. Good luck.
