Legal Question in Family Law in California

court ordered child support from another state

my husband has a court order child support from the state of california. We live in arkansas. These are arrears, the child is not a minor (22). The amount that is being taken out of his check is quite a bit. There is a clause on the paperwork that says take out this certain amount or the amount that is required by the state that he is employed in. Is there a way to get this amount reduced according to what the state of arkansas requires. He does not make a lot of money here and it is hard for us to live off of the amount that is left after this large amount is taken out. He understands that he has to pay this money, but the wages made here in the south are not as high as those made in California. Is it possible to reduce this amount? If so do we need to get an attorney or what steps do we need to take? Thank you

It is possible to reduce the monthly amount. Talk to an attorney in the County where the child support order was made. He can give you a better idea of what can be done. Good Luck, Pat McCrary

It is usually very possible to reduce the amount - depending, of course, on the circumstances.

You need to hire an attorney in the county in California where the order was made. If the order was made in Los Angeles or Orange county, please feel free to call us toll free at 877-601-8133 and ask for Pam. Pam will be more than happy to discuss the matter with you.

In California child support arrears accrue interest at the rate of 10% per year. Unless the monthly payment is greater than the interest he will be going into the hole. For Example if the arrears are $60,000 then the payment must exceed $500 per month for him to reduce the total amount due.
