Legal Question in Family Law in California

Court ordered visitation

My son's mother (we were never

married) continues to deny me the

court-ordered visitation. She always

has some excuse - school events,

non-school events, family events

(her family), etc. When I ask for

make-up time, she says no, that is

not allowed. What recourse do I

have?

Re: Court ordered visitation

This is a very common situation, but with complex repercussions. I strongly suggest you consult with an attorney in your county.

You need to document each visitation violation. You need to demand your time, but not at the expense of your son. If you have sufficient neutral third party supported evidence of the visitation violations, you cna try to bring a contempt, but that is seeking to punish mother for violating order and threatening prison. Make sure you want to make things that bad.

When you consult with an attorney in your county, you will discuss the very precise rules for contempt and see if they apply. If not, then you might seek modification of visitation instead.
