Legal Question in Family Law in California

court orders

The court ordered my hustband's ex to seek full time employment and to give him a plan in a reasonable amount of time. This was back in January of 2000. It has been over 6 months and she has not even tried to get a job. Right after the court date, she went a started volunteering at some abortion clinic and says she cannot work full time because she volunteers. Can we and how do we make her abide by the court order.

Re: court orders

Depends. How much money do you want to spend. First of all, you could get an order that she submit to a vocational evaluation. From that you could ask the court to impute income to her so support would be reduced whether she worked or not.

Or you could just take her back to court and lay out your own facts that she has certain job skills that would pay X and that there is a market for those skills and she is willfully refusing to work.

Outcome can vary, depending if child or spousal support. If the latter, the court could just cut her off.
