Legal Question in Family Law in California

We currently have a court-ordered child support case and his wages are being garnished even though I have no idea where the NCP is at. It's been 5 years and his wages are still being garnished and we still haven't heard from him. I tried filing for modification but they want me to provide an address (I don't have one), I guess I can send it to his last known address? What happens if I file for modification (since custody shows he still gets our child) of custody and support and he doesn't show up? Thank you for any and all help.

If your child support is being enforced through the Department of Child Support Services and they have a wage assignment, they should know where he is working. File your motion and go ex-parte and ask the judge to order DCSS to serve him or to provide you with the address. If not you can publish you modification request. If he does not show, the order is entered by default. Pat McCrary
