Legal Question in Family Law in California
When CP not complying and CPS not investigating?
We hired a private investigator and he has confirmed that my husband's 4yr. old son is being cared for by a 16 yr old kid w/mental problems and he's also a homosexual. We've made several phone calls to CPS and now two weeks later no social worker has been out there to look into it! How long do we need to wait to go into court on an ex parte to get at least temp. custody pending an investigation? WORRIED FATHER NEEDS HELP!

You shouldn't delay in going to family court for an temporary order changing custody. Any delay will only serve to weaken you statements. If it is truly an emergency and the child is at risk immediate action is required.
