Legal Question in Family Law in California
CPS is assisting father to harass mother.
My child was 3 mos old the judge awarded me full custody with no visitation to father, and has to pay CS.Father is in NC, mother is in CA. Shortly after the father learned that he had no rights or visitations he made an anonymous false report with child protective svs against me.CPS came to my house and investigated. I was so humiliated! The case was unfounded. The child is now 2 .Time pasted..I let all the past go and we began to communicate (big mistake!). Communication between us was going well well enough for mother and child to fly to NC recently so the father can see the child for the first time in person. Father left mother when she was 5 mos preganant.3 days there and I ended up calling the police because he was harassing me by continuously calling and text messaging after asked not too. He wanted to take the baby alone, I said no. Then it went down hill from there. We got home to CA, he continued to call and today CPS knocked on my door. I called the number on the card and spoke to the worker. Again an anonymous call came in against me. I refused to allow them in my house, and contacted the workers supervisor. Is there anything I can do legally about the CPS false reports, and is there anything else i should do?

Re: CPS is assisting father to harass mother.
CPS must investigate any report received if that report appears to have credibility based solely on information received. The general rule is that after two or three calls and learning that the parties are involved in a custody and visitation dispute these reports are given not credibility. Then CPS will stop coming out on the reports. You should also consider following the no visitation provision of the custody order.
