Legal Question in Family Law in California

Cps

My brothers 2 boys ages 1 and 3

years have been in protective costody

for 6 months. I am approved to be

their foster parent but they are not

being placed in my home. What can

I do to get them into my home? I

live in Stanislaus County, CA they

live in San Diego County, CA. The

parents each have 2 hours visitation

per week.

You need to convince the court that they may be adequately supervised by Stanislaus county child protection services. That may be accomplished by a motion. Contact me directly.

You should call CPS and ask them what is the hold up. If the parents consent to you being the foster parent that should provide some weight for CPS to release the children into your care.

There are two factors that may be causing the situation. 1st Stanislaus county it too far from San Diego County for parents to have regular contact with the boys. 2nd CPS is looking for foster family that will adopt if reunification is not successful. The time for reunification is only 6 months for children under three years of age. You should immediately contact CPS and if they are not willing to place the child with you then retain an attorney immediately.
