Legal Question in Family Law in California

CPS Drug Testing

My 9 yr, old grandson is in cps custody, as a grandparent I am allowed to visit 1x a month. I went to my first visit and after the visit a cps worker handed me and my daughter (his mother) a paper stating we both had to drug test and failure to do so would be considered a dirty. Does CPS have the right to drug test me. I was not arrested for drugs and I am not involved with CPS.

Re: CPS Drug Testing

I do not know if CPS has the right to require you to test. Have you called them to find out why they would require you to test? Ask. If it is based on statute get the citation. If it is a court order, get a copy. At the same time ask that the restriction be removed as a condition for your visits.

If this does not take care of it, seek the opinion of local counsel or call our office to schedule a prepaid consultation.
